The government should give a compensation of ₹ 200000 to the woman who harmed her reputation--Madras High Court

The Madras High Court held the state liable for harassing a woman and harming her reputation by filing a false case by the police under the Immoral Traffic (Prevention) Act and ordered to pay compensation of ₹ 200000 to the victim woman within 2 months.                                                            According to the case, a woman was working as a yoga teacher in Kanyakumari.He rented a house with his family in 2009.In 2010, the woman was arrested by the police on the basis of a false complaint.Police claimed that the woman was involved in prostitution trade.The woman was also kept in a rehabilitation center during her detention..Later the matter was investigated by a Deputy Superintendent of Police after his investigation it was found that the woman is innocent.The woman has been implicated in a false case by the policemen of the local police station at the behest of the landlord.The person complaining against the woman had told that he had come to the police station in connection with a case, only then Policemen had signed on plain paper.After the investigation report of the Deputy Superintendent of Police, the woman filed a petition in the High Court demanding the dismissal of the pending case against her.The case pending against the woman was dismissed on the orders of the High Court,But the woman sought compensation of Rs 10000000 from the government, saying that her case was widely published in the media.The woman filed a petition in the High Court after the government rejected her demand for compensation.In the petition, a demand was made to order the compensation of 10000000 rupees.                                                                            During the hearing of the case, the public prosecutor argued that the mistake committed by the local policemen was rectified through an inquiry by the Deputy Superintendent of Police, therefore the State could not be held liable.                                                                                         Justice Vijay Kumar, who heard the case, rejected the government's objections.He said that the government has failed to take action against the policemen who harassed the woman by registering a false case.Who implicated the innocent woman in a false case by taking the signature of the complainant on blank papers.Therefore the government cannot escape its responsibility.Making the above comment, the court has ordered the state government to give compensation amount of ₹ 200000 to the victim woman.
