Prisoner convicted for marrying girlfriend should be released on parole for 15 days--karnataka high court

The Karnataka High Court has ordered the release of a convicted prisoner on parole for 15 days so that he can marry his girlfriend.The prisoner was convicted in a case of murder The convict is in jail in the same case of murder.                                                               The prisoner's mother Ratnamma and Neeta, who claimed to be his girlfriend, had filed a petition in the High Court seeking a direction to release Anand on parole for 15 days.In the petition, the prisoner's girlfriend said that she is in love with Anand for the last 9 years.The girlfriend had further said that if Anand was not released on parole, she would marry someone else.Anand's release is necessary or else she will lose the love of her life.It was also said that prisoner Anand would not be able to bear the pain of his love getting married to another person due to his imprisonment.                                  The public prosecutor objected to the arguments of the petitioner and said that there is no provision for granting parole for getting married.It would be a different situation if the prisoner wanted to attend someone else's wedding.There is no provision for granting parole to a prisoner for getting married as per the jail manual.                                                      Justice M Nag Prasanna's bench said that according to the public prosecutor, this prisoner cannot get the right of parole under Section 636 of the Jail Rules.Sub-clause 12 of section 636 of the Prison Rules empowers the head of the institution to grant parole in any other exceptional circumstances.The court said that considering this as an extraordinary situation, it directs the release of the said prisoner on parole. During the hearing of the petition, several earlier decisions were also cited on behalf of the petitioner.                                                                          The court considered that this was an extraordinary circumstance. The accused was sentenced to 10 years, out of which he has completed 6 years.The court directed the Deputy Inspector General of Prisons and the Chief Superintendent of Police, Parappana Agrahara Central Jail, to consider the petitioner's application and release prisoner Anand on parole from morning 5 April 2023 to evening 20 April 2023.The court has also allowed the authorities to impose such conditions while releasing Anand on parole as are imposed while releasing other prisoners on parole.
