Can rape case be settled on the basis of compromise ?

The Chhattisgarh High Court quashes a rape case, observing that the case relating to the crime can be quashed if the main reason for the dispute is gone.                                                 The bench of Justice Rajni Dubey made this remark while ordering the cancellation of the FIR of the case on the petition of the accused.                                                                According to the case, on June 26, 2021, the victim lodged an FIR under rape and SC/ ST Act at a police station in Bilaspur district.During the pendency of the case, a settlement was reached between the accused and the victim.Under the agreement, the accused married the victim. After settlement, the accused filed a petition in the High Court for F.I.R. sought to cancel.                                                          In the petition filed in the High Court, it was said that both of them got married.Both are living together,  happily and peacefully leading a married life.After marriage, a child has also been born to both of them. The victim does not want further action in the case.The documents of the agreement have also been presented in the police station.The victim also submitted an affidavit in the High Court to the effect that the victim has no objection to quashing the FIR.Along with this, the petitioner, citing the decision of the Supreme Court, demanded the cancellation of the FIR.                                                                 A single judge bench of Justice Rajni Dubey accepted the petition of the accused on the basis of documents submitted in the petition and hearing of the case.The court held that if the main cause between the victim and the accused has ended then the F.I.R. can be canceled The F.I.R registered in this case of rape. The main reason was that the accused did not want to marry the victim, due to which the victim lodged an FIR.Now at present the accused has married the victim so the main reason for the crime has also ended.                            The High Court said that the FIR registered on the charge of rape can be quashed on the basis of mutual agreement between the victim and the accused if the victim does not want to proceed further in the matter.Commenting that the victim and the accused have married, the root cause of the crime registered has no longer remained, the High Court Justice Dubey quashed all the proceedings related to the case including the FIR lodged in the police station.
