Expressing love by holding a girl's hand is not molestation with a girl.----- Bombay High Court

According to the case, the victim girl used to go to college and tuition in the auto of the accused, later the girl stopped going to college and tuition in the auto of the accused.So the accused started chasing the girl. The accused is accused that on November 1, 2022, he expressed his love to the minor girl by holding her hand The accused also offered to drop the victim on his bike, but the victim somehow reached her home and narrated the ordeal to her father..After which the girl's father lodged a complaint with the police station. In the complaint, it was alleged that auto driver Dhanraj Babu Singh Rathore tried to sexually assault his 17-year-old daughter.                               The accused filed an anticipatory bail application in the Bombay High Court which was heard by a single bench of Justice Bharati Dangre at the Nagpur Bench of the Bombay High Court During the hearing, the court said that prima facie there is no case of sexual assault as the accused did not hold the hand of the victim with the intention of sexually assaulting her.It is clear from victim' s statement that the intention of the accused was not to sexually assault the victim.                                                                                 The court while granting anticipatory bail to the accused said that he will not do any such work in future otherwise the anticipatory bail granted to him will be cancelled.
