rape case can not quash on the ground of settlement Rape is a crime against the society. the court refused to quash it on the ground of settlement between the accused and the complainant. Andhra Pradesh High court refuses to quash a conviction order in a rape case. the court said that rape is a crime against the society it is not an offense in which both the parties can reach settlement. the victim told the court that she was in love with the accused.but was unable to get married due to some reason.Due to misunderstanding she lodged a f.i.r.with the police.As a result of which the accused has been convicted.after settlement, the the victim had requested the court to quash the conviction.court relied on a decision of the Supreme court which said rape or attempt to rape is an offense against a woman's body which is her temple.the court held that the accused have been convicted of a heinous crime.therefore , the court can not quash the sentence merey on the ground that a settlement has been changed reached between parties. the court said that there can be no compromise with the respect of woman. byIndian law express -Sunday, January 02, 2022
