 Delhi Police may have given relief to BJP MP Brij Bhushan Sharan Singh in the case of sexual assault of a minor But the charge sheet against Brijbhushan Sharan Singh has been submitted in the court on the complaint lodged in the case of adult women wrestlers under sections 354,354A and 354D of IPC .In this case, a case will be filed against the accused MP in the MP MLA court in Delhi.                                                                                            Delhi Police submits closure report in minor sexual assault case after minor changes her statement. The minor in her changed statement has said that she was discriminated against due to which she was in anger and depression. That's why a complaint was filed alleging sexual harassment. The closure report submitted by the police in this case is likely to be accepted by the court .However, even in this case, the court can ask many questions to the Delhi Police, such as when the case was of sexual harassment of a minor, why did the police not arrest the accused, while the case was registered under the POCSO Act. Why did the police wait for the minor to change his statement? What evidence has the police collected regarding the age of the minor?Under Section 164 of CrPC, the minor has recorded two statements before the Magistrate, which statements are considered correct by the court. The court can also examine the minor by calling him whether there is any pressure on the minor to change the statement.                                                          In the case of adult wrestlers, evidence will be presented from both sides.,,If the accused MPs are found guilty from the evidence presented, then they can be punished under section 354 of IPC from 1 year to 5 years.Section 354 of IPC is non-bailable in which the accused MP will need to take bail from the court. At the time of granting bail, the court can impose reasonable and necessary conditions on the accused. Offenses under section 354A and 354D of IPC are bailable. On conviction under section 354A that the punishment awarded under section 354 may be extended for a further term of 3 years and shall also be liable to fine.If found guilty under 354D, there is a provision of punishment ranging from 1 to 3 years and fine.
