Government should withdraw the compensation amount from the rape victim who changed her statement .

Reversing of a rape victim's statement has become harmful.The rape victim, who turns from her statements by not supporting the prosecution, will have to return the compensation amount to the government after the order of the High Court.The High Court has ordered the government to withdraw the compensation amount from the victim.                     The court was hearing the bail application of the person accused in the case.The accused told the court that the victim had stated in her statements during the trial before the trial court that she could not see the face of the person who had raped her and didn't recognize him.                      The public prosecutor told the court that the victim has not supported the statements made before the magistrate.Not only this, the victim's brother and the complainant in this case have also turned hostile and are not supporting the prosecution.The public prosecutor requested the court that in cases registered under Indian Penal Code section 376 and the Protection of Children from Sexual Offenses Act, financial assistance is given to the victim and her family.Since the victim in the case has now turned hostile and is not supporting the prosecution, the amount paid to her should be recovered.                                                  On the request of the public prosecutor, a single-judge bench of Justice Brijraj Singh of the Lucknow bench of the Allahabad High Court hearing a bail application Jeetan Load alias Jitendra,resident of Unnao, who was jailed under the charges of the POCSO Act.That bench said that if the victim denies the allegations during the trial, then there is no justification for her to keep the compensation amount provided by the state government.                                                         The court said that the state exchequer cannot be burdened.This will lead to the possibility of misuse of laws.In such a situation, it is appropriate to take back the compensation amount paid to the victim.                                                                      The Judge said that in my opinion, if the victim retracts from the statement and does not support the allegations made in the case, then the compensation amount given to the victim by the government should be recovered from the victim.                                                                                ,Passing a detailed order in this regard, the court has directed the state government to withdraw the amount of compensation from the alleged rape victim who retracts her statement by not supporting the allegations during the trial.                The court has asked the government to issue directions to the concerned authorities in this regard.Along with this, Along with this, the court has also directed to submit the progress report of the action taken in relation to this order in the court on the next date.                                         The court has asked the registrar to send a copy of the order to the Chief Secretary, Government of Uttar Pradesh, so that compliance of the order can be ensured.
