According to the case, the victim was sleeping on the cot in varandah at around 11:00 on the night of 18 November 2020. Accused Brijesh Banjara come to the varandah and started talking the victim with him.when the victim returns home, tell the whole incident to the family members. A report of the incident was lodged in the police station in the morning. The police started the investigation by registering an offence under section 450,363,376,506 of the Indian Penal code and section 3/4 of the POCSO Act. After the investigation, the charge sheet was presented in the court. During hearing in the court, the victim and her family members retracted their statements.
The special feature of the case is that the court sentenced the accused even though the victim and her family members turned hostile.
The court convicted the accused on the basis of the statement recorded under section 164 of the criminal procedure code and the C.D.of the statement given by the victim to the police and the D. N. A.profile of the accused on the salwar of the victim in the D. N. A. report
Referring to a judgement, special judge Varsha Sharma observed that the judicial system can not be fun of by witnesses turning hostile.
