Occupation of government land in the name of temple is not allowed .

The Madras High court dismissed that petition.In which there was a demand to quash the notice issued by the Highway Department for removal of a temple at Vippanthattai in Parambalur district of Tamil nadu.
           A Division bench of Justice S. Vaidyanathan and Justice D. Bharat Chakraborty said that the petitioner can not usurp the highway property under guise of establishment of the temple.Which is for public use instead of any cult cast and religion.
          The court observed that God is omnipresent.God don't need any special place for his divine presence.If the petitioner wants to build a temple for worship,he can build a temple on his own land or on the land available for the temple, and can move the idol of God to that place.
        According to the case, The State Highway Department had given notice to remove the temple from its land . The Trustee of the temple, s.periyaswamy,had filed a petition in the High court seeking quashing of the notice. The petitioner had argued that the temple has been here for more than three decades. The petitioner said that while building this temple, care was taken that there should be no problem in the movement of vehicles on the highway.
            The High court disagreed with the arguments of the petitioner and said that if this temple is here for the last three decades.So the petitioner should show the documents which can prove that this land belongs to the temple. The High court further said, that if the temple is allowed to stay here,then everyone will make such a demand.
