The Bombay High Court made the observation while hearing a case of domestic dispute.couples for marriage are made in hell, not in heaven. The wife had accused the husband of cruelty and demanding dowry.After hearing the case, the High Court decided to grant anticipatory bail to the husband.
According to the case,a woman had filed a Complaint against her husband in December 2021.In the Complaint, the woman had alleged that during the marriage in 2017 the husband's family wanted one gold coin for each member of their household. Because the woman's family could not fulfill this demand. So the in-laws started harrassing her. The wife claimed that she paid ₹13,50000 to buy the flat. The wife also alleged that the husband inflicted some wounds on himself to show that the wife had assaulted him.
The husband said that he had taken a loan of₹90 lakh to buy the flat After marriage,he took his wife to Mauritius and also gifted an expensive mobile phone to the wife. The husband alleged that he had lodged a Complaint against the wife, out of revenge, the wife filed a case against him.
On the Complaint of the wife,a case was registered under section 498A of the lndian Penal code and the Dowry Prohibition Act. The accused husband had applied for anticipatory bail in the High court. While hearing the bail application, the court observed that the husband and wife have filed cross Complaints against each other and made allegations. Justice S.V. Kotwal said that the facts present show that husband and wife can not live together there are constant fights between them. After considering the arguments of both the parties, the court said that the custody of the husband will not solve the issue. The custodial interrogation of the accused husband is also not required for the purpose of investigation. The court ordered that in the event of arrest, the husband should be released on bail on a surety of ₹30000 along with one or more sureties. The court has also ordered the accused to co-operate in police investigation.
