The mother of two children has left her husband and children and is living with her lover. On a petition filed by the husband, the High Court refused to interfere in the matter.

 Uttarakhand High Court refuses to issue writ in favor of husband on habeas corpus petition filed by husband and the mother of two children who has left her husband and children and is living with her lover is allowed to live with her lover from whom the wife was identified through social media .                             According to the case, the couple got married in 2012 and both have two children from this marriage. Out of which the age of the boy is about 10 years and the age of the girl is about 6 years. In 2022, the woman left her husband and children and went to Faridabad where her parents also live. After that the woman did not return to her husband and children and started living with her lover in Faridabad. When the husband, a resident of Dehradun, a gym trainer by profession, came to know about this act of his wife, he filed a habeas corpus petition in the High Court to free his wife from the illegal custody of her lover.                                       This habeas corpus petition was heard by a division bench of Justice Manoj Kumar Tiwari and Justice Pankaj Purohit.                                                                         The court directed the police chiefs of Dehradun and Faridabad to ensure the presence of the woman in the court. As per the order of the court, the police ensured the presence of the woman, Woman appears in court alleges husband used to misbehave with her so she left her house. Woman says she is living with lover of her own free will and she refused to live with husband. Although the husband denied that he misbehaved, he said that the wife had left the house without any reason.                                                                          After hearing both the sides, the court told the husband that it could not help him as the woman was not ready to live with the husband and the children. She has clearly stated that she is living with her lover on her own free will, in such a situation it is not right to give any orders to her. Thus the court dismissed the habeas corpus petition filed by the husband, refusing to interfere in the matter.
