The Allahabad High Court, while rejecting the bail application of an accused who killed a woman by using tantra mantras to cure infertility, has observed that People who believe that infertility of women can be treated by using tantra mantra, they are definitely born in 21st century but their mindset is of a man born in stone age. According to the allegations leveled in the case, members of a family hatched a conspiracy against the woman on the advice of a tantrik, considering a woman of the family responsible for infertility and subjected the woman to tantric rituals in furtherance of their common intention.During these tantric rituals, the accused subjected the woman to severe physical torture.The woman was repeatedly burnt with hot tongs and due to which the woman died.The accused is the brother-in-law of the deceased woman who had applied for bail.After the death of the woman, a case was registered against the accused under sections 498a, 506, 504, 302, 508 ,120b and 34 of the Indian Penal Code. According to the post mortem report of the deceased woman, 17 injuries were found on her body, many of these injuries were of burn woman.The immediate cause of death was head injury which was a lacerated wound due to which the deceased had lapsed into a coma. The court said that the facts of the case are surprising and reflect the mindset of men.When a woman is unable to conceive for many years, the woman is held responsible and forced to engage in tantric rituals for the same.Woman subjected to gruesome torture during Tantra Mantra procedure in the name of curing infertility Which is a curse for the society that even in the 21st century such tantric activities are in vogue. The court said the mindset of the applicant and other accused is such that they believe in witchcraft to cure female infertility before ascertaining that it could be a case of male infertility.This mentality of the accused is not like the people living in the 21st century but like the people living in the stone age. Today science has developed to such an extent that whether it is male or female infertility can be treated by doctors, so there is absolutely no bailout at this stage. The accused had given a bail application in the Sessions Court, which was rejected by the Sessions Judge, Shahjahanpur, after which the accused had submitted a bail application in the High Court. The counsel for the applicant before the bench of Justice Saurabh Shyam Shamsheri had tried to make out a case for bail on the basis of the recorded statements of the witnesses during investigation but the counsel for the applicant failed to make out a case for bail, the court said that apart from the independent witness in the case, there is also an eyewitness who completely corroborates the prosecution case. The court observed how the deceased was tortured by tantra mantra methods and taking into account the nature and number of injuries inflicted on the body of the deceased, the court concluded that the evidence collected during the course of investigation corroborates the case of the prosecution. Following this finding, the court rejected the bail application with a direction that if there is no legal impediment, the trial may be concluded by the trial court within one year.
