Petitioner Ganga Kumari is a transgender and working in Police Department. She had participated in the recruitment process of Sub-inspector. The petitioner had filed a petition in the High Court seeking reservation for transgenders following the order of the Supreme Court. The petitioner argued that despite the directions of the Supreme Court, it has not been implemented in the state so far. The state's argument was that giving or not giving reservation is prerogative of the state.
A division bench of Justice Madan Gopal Vyas and Justice Manindra Mohan Srivastava heard the matter. The court said that the state is bound to comply with the orders of the Supreme Court. In the order of the Supreme Court, the responsibility of making rules and regulations regarding reservation has been put on the state government. The court said that the order of the Supreme Court had come a long time ago. The court ordered that the state government should comply with the order of Supreme Court in four months. The court directed that the petitioner's candidature for the post of Sub-inspector shall not be dismissed on the ground that the petitioner is third gender.
