Female sterilization operation unsuccessful, The family and the child are entitled to compensation. -Madras High Court

After a woman has undergone female sterilization operation five year after the woman conceived and gave birth to a girl child. The Madras High Court has ordered the Tamil nadu government to pay ₹3,00000 to the woman and ₹10,000 per month to the child until the girl child turns 21 and completes her graduation.
Justice Krishnan Ramaswamy passed the order on a petition filed by Dhanam,a resident of Aralboimojhi in Kanyakumari district, taking serious note of the negligence of doctors due to failure in family planning operation.
According to the case, the mother of two children had undergone female sterilization operation at Kanyakumari government medical college hospital. After female sterilization operation, the woman gave birth to a baby girl in 2017. The birth of a child was going to add more trouble for the family struggling with financial problems.due to the birth of the child, the family was afraid that the government assistance for their two girls under the government welfare scheme should not be stopped. Therefore, the petitioner demanded a compensation of ₹10,00000 from the state health department for nurturing the child.But the health department officials rejected the petitioner's application.
The aggrieved petitioner filed a petition in the High Court seeking an order to provide compensation to the officials of the health department. The court has said in the decision that the state is responsible for bringing the third child. One who is unwanted child to the family . Because child is a result of failure of female sterilization operation. The court of this view that the petitioner and the child are entitled to compensation.
