The Salaries of regular appointed and compassionate appointees can not be different.The Supreme court has said in a case.As soon as a person is appointed to a certain post.The person becomes entitled to the pay fixed for that post.Even if the person has been appointed on the basis of compassionate appointment. The Lucknow Bench of the Allahabad High court had directed to pay the prescribed salary for that post to a woman who got compassionate appointment after the death of her husband.The U. P. Government had appointed the woman to the post of officer on duty.but the woman was being paid less than the pay prescribed for that post.The High court,while accepting the woman's demand to get the prescribed salary for the above post,directed the U. P. Government to pay the prescribed salary for the post.Against the order of the High court,the U. P. Government had filed a special leave petition in the Supreme court.which was dismissed by a bench of Justice M. R.Shah and Justice V. V. Nagratna and directed to comply with the order of the High court.on the behalf of the government,the compassionate appointment of the woman has been made on the created post.the government also said that compassionate appointment can not be given to the post of officer on duty.the court refused to accept the government argument and said the government has appointed the woman to the said post.the government can no longer make this argument.there can not be different pay for regular appointed and compassionate appointees.
